These terms govern your organization's use of WarHorse. They are written to be read, not to be survived. Where a term is enforced by the software rather than by trust, we say so. This is a draft pending final legal review.
These terms are an agreement between Housewives & Co. ("we", "us"), the Canadian company that builds and operates WarHorse, and the organization that uses it ("you") — a political campaign, riding association, registered party, charity, or advocacy group. The person who accepts these terms confirms they are authorized to bind that organization. If you are just browsing this website, only the sections that can apply to a visitor do.
A separate order or proposal sets out your plan, price and start date. Where it and these terms disagree, the order wins for that point.
WarHorse is a platform for Canadian campaigns and nonprofits: a website and content management system, donation and event handling (WarChest), supporter records, and email (WarHorn). What your plan includes is set out in your order and on our pricing page. We add and improve features over time; we will not remove one you rely on without telling you first.
We run WarHorse as a managed service. You do not host it, patch it, or operate its servers — we do.
Access to the administration area is by named accounts on an explicit allowlist, signed in through Google. You are responsible for who you add and for what they do. Tell us promptly if an account should no longer have access or if you suspect one has been misused. We do not see your Google password and never ask for it.
Your use of WarHorse is subject to our Acceptable Use & Anti-Spam Policy, which forms part of these terms. In short:
You keep sole responsibility for the content you send and publish, and for its accuracy and legality. You will not use the platform to break the law, infringe someone's rights, or send malware.
Your supporters, donors, records, content and lists belong to you, not to us. We hold them to run the service for you, and we act on your instructions. We do not sell your data, and we do not use one client's data to benefit another.
We keep backups and operational records for the periods described in the Privacy Policy. Some records are, by design, append-only — the consent ledger, suppressions, and financial audit trails — because their integrity is the point of them, and we will keep those as long as the law and good practice require.
Email sent through WarHorn goes out on shared infrastructure under your own verified sending domain. Because one bad list can hurt every organization on that infrastructure, sending carries conditions beyond the rest of the platform:
We do not embed open-tracking pixels, and we report delivery honestly — delivered, bounced, unsubscribed, complained, and clicked through — rather than guessing at opens.
Fees, the billing period, and any platform fee on money you raise are set out in your order and on the pricing page. All prices are in Canadian dollars and are exclusive of applicable taxes unless stated.
We work to keep WarHorse available and fast, but we do not promise it will never be down. Maintenance, provider outages, and events beyond our control happen. We will give reasonable notice of planned maintenance where we can. Support is provided as your plan and order describe; the fastest way to reach us is hello@warhorseapp.com.
WarHorse runs on services we have chosen for their standards and their Canadian presence. Your data and records live in Google Cloud's Montréal region. Email is delivered through Amazon Web Services in the Canada (Central) region. Payments are processed by Stripe. Sign-in uses Google. Using WarHorse means your data is processed by these providers for the purpose of running the service; the Privacy Policy names them and what each one does.
Either of us may end the relationship as your order describes — usually with notice before the next billing period. You may stop using WarHorse at any time; fees for the current period remain due.
We may suspend sending, or the account, without prior notice if there is a serious or ongoing breach of the Acceptable Use Policy, a legal requirement, a security risk to the platform, or unpaid fees after notice. Where we can, we suspend the narrowest thing — sending rather than the whole account — and tell you why and how to put it right. Repeated or deliberate breach ends the relationship.
When the relationship ends, we give you a reasonable window to export your data, then delete or de-identify it in line with the Privacy Policy, keeping only the append-only and legally required records described there.
We provide WarHorse with reasonable skill and care. Beyond that, and to the extent the law allows, the service is provided "as is": we do not warrant that it will be uninterrupted or error-free, or that it will meet every need you have in mind.
Nothing here limits liability that cannot be limited by law — and there is plenty that cannot. Subject to that, neither of us is liable to the other for indirect or consequential loss, or for lost profits, revenue, goodwill or data; and our total liability arising from the service in any twelve-month period is limited to the fees you paid us for the service in that period. You are responsible for the content you send and publish, and you will cover us against third-party claims that arise from it or from your breach of these terms.
We may update these terms as the product and the law change. If a change materially affects you, we will give reasonable notice — by email or in the admin area — before it takes effect. Continuing to use WarHorse after that means you accept the updated terms. The "last updated" date at the top always reflects the current version.
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, and the courts of Alberta have jurisdiction — without affecting any right you have under the consumer or privacy laws of your own province.
Questions about these terms, your plan, or your data go to hello@warhorseapp.com, or by mail to Housewives & Co. at the address given in the footer of email we send you.
